Agreement
These Terms of Service (“Terms”) are an agreement between you and Tall Timbers Group LLC (“OurStudentParty,” “we,” “us”). By creating an account, running an event, or registering, volunteering, sponsoring or donating through an event site, you agree to these Terms and to our Privacy Policy.
If you accept these Terms on behalf of a group — a PTO, booster club, committee or school — you confirm you are authorized to do so, and “you” includes that group.
Who's who
- Organizer: the group that creates and runs an event, and the committee members it invites.
- Participant: anyone who registers, pays, volunteers, sponsors or donates through an event site.
- Us: we provide the software and collect card payments on the Organizer's behalf. We do not run, host, supervise or insure any event.
Accounts and sign‑in
You must be at least 18 to create an Organizer account. Keep your sign‑in details private, and tell us right away at [email protected] if you think your account has been used without permission. Organizers are responsible for who they give admin access to and at what level.
Organizer responsibilities
As an Organizer, you agree to:
- Have the right to run your event and to collect money for it, including any approval your school, district or parent organization requires
- Collect only the participant information you actually need, and use it only for your event
- Get any consent required for the information you collect, including parental consent for minors
- Limit access to sensitive details, such as dietary and allergy notes, to people who need them
- Set, publish and honor your own refund policy
- Keep your event site accurate, and comply with the laws that apply to your event, fundraising and raffles
Payments and fees
- Fee. For each ticket, donation or sponsorship paid through OurStudentParty, our platform fee is 1% of the amount plus $0.75, up to a maximum of $6.00 per transaction. Card processing fees (2.9% + 30¢) are charged separately. Both are deducted from each payment before the Organizer is paid. There are no monthly or setup fees, and no credit card is required to open an account.
How card payments are collected
- We collect, the Organizer receives. Card payments are taken by OurStudentParty on the Organizer's behalf. OurStudentParty is the merchant of record with our card processor, so the charge is made by us, not by the Organizer.
- Processors. New card payments are processed by Stripe through a secure payment form on our pages; card details go straight to Stripe. Card payments made before October 2026 were processed by JustiFi; refunds of those payments are handled through JustiFi. Organizers do not need their own Stripe or JustiFi account.
- Card statements. Payers' card statements currently show the charge as STDT_PARTY* followed by a short name for the school or group, for example STDT_PARTY* LINCOLN HS. Older purchases may show OurStudentParty instead. We choose the short name from the Organizer's name so that families will recognize it; the Organizer can ask us to change it. Our help page, Help recognizing STDT_PARTY* card charges, explains the description and lets payers have their receipts sent again.
How Organizers are paid
- Where the money goes first. Our processors deposit payment proceeds into OurStudentParty's account at Mercury, our bank. We then send each Organizer's share by ACH bank transfer from that account to the bank account the Organizer sets up in OurStudentParty.
- When. OurStudentParty creates payouts automatically each month for money that has reached our bank account and has not already been paid out, up to the cutoff shown in your account settings. A final payout for an event follows the event's end, after the delay shown in your account settings. We review each payout before it is sent, and the Organizer's bank may take a few business days to show it.
- Expedited payouts. An Organizer may ask for an expedited payout instead of waiting for the next scheduled one. It carries a small fee, which we show before the Organizer confirms and deduct from that payout.
- Reserve. If the Organizer agrees to a reserve with OurStudentParty, we hold back the agreed share of an event's proceeds until the agreed release date, then pay it out once any refunds or disputes for that event are resolved. A reserve applies only when it has been agreed with the Organizer in advance, on the terms shown in your account settings or as otherwise agreed; it is not an extra fee.
- Payout details. The Organizer is responsible for giving us accurate bank details and keeping them up to date. Payouts sent to the bank account the Organizer provided are treated as received by the Organizer.
Refunds, disputes and losses
- Refunds. Refunds are the Organizer's decision under the Organizer's refund policy. When a payment is fully refunded, we do not charge our platform fee on it. The card processor keeps its processing fee. A refund made after the Organizer has already been paid for that payment is recovered as described below.
- Disputes and chargebacks. If a payer disputes a charge, we respond to the card network, using the receipt and event details we hold, and we may ask the Organizer for more evidence. If the dispute is lost, the Organizer is responsible for the disputed amount and for the processor's actual dispute fee. We do not charge an extra fee of our own for disputes.
- How we recover amounts owed. Amounts an Organizer owes for refunds or lost disputes are taken first from that event's reserve, if one has been agreed, and then from the Organizer's future proceeds. Only if the Organizer has agreed with us in advance may we also charge a card the Organizer saved with us, or apply a reserve held for a different event. We may hold payouts while an amount remains owed. We may also choose to cover some or all of a loss ourselves, but are not required to.
- Fee changes. We will give Organizers at least 30 days' notice by email before any fee increase. It will not apply to events already open for registration.
Donations
Donations are for the Organizer, not for us. We collect them on the Organizer's behalf and pass them on, less the fees in Section 5. Whether a donation is tax‑deductible depends on the Organizer's tax status, and the Organizer is responsible for any receipts or acknowledgements the law requires.
Your content and your event site
You keep ownership of everything you upload or write — text, photos, logos and participant information. You give us permission to host, display, copy and process that content only as needed to run the service for you, including copying it into a new event when you use Copy Event.
Only upload photos and logos you have the right to use. Get permission before posting identifiable photos of students where your school requires it.
The Site Assistant (AI)
The Site Assistant can answer questions and make changes to your event site. It can be wrong. Review its page edits before you publish them, check changes it makes to event details or site style, and undo anything you don't like. You are responsible for what appears on your event site. Only paste links into the chat that you are allowed to share.
Acceptable use
Don't use OurStudentParty to:
- Collect money for anything other than the event you describe
- Run a raffle, lottery or game of chance where it is not legal
- Post anything unlawful, harassing, sexually explicit or discriminatory
- Collect information you don't need, or use participant information for anything outside your event
- Attack, probe, scrape or overload the service, or get around any access limit
Privacy
Our Privacy Policy explains how we handle personal information. For participant information, we act as the Organizer's service provider and follow the Organizer's instructions, within the limits of that policy.
Suspension and termination
You can close your account at any time. We may suspend or close an account that breaks these Terms, puts participants at risk, or that our payment processors require us to stop serving. Unless the situation is urgent, we will tell you why first and give you a chance to fix it. After closure, you will have 30 days to export your data.
Disclaimers
We work hard to keep OurStudentParty reliable, but it is provided “as is” and “as available.” To the extent the law allows, we disclaim implied warranties, including merchantability, fitness for a particular purpose and non‑infringement. We are not responsible for the events themselves, including safety, supervision, transportation or anything that happens at or around an event.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits or data. Our total liability for any claim relating to the service is limited to the fees you paid us in the 12 months before the claim, or $100, whichever is greater.
Indemnity
Organizers agree to defend and indemnify us against claims arising from their event, their content, or their breach of these Terms.
Disputes and governing law
These Terms are governed by the laws of the State of Minnesota, without regard to conflict‑of‑law rules. Any dispute will be resolved in the state or federal courts located in Crow Wing County, Minnesota. Before filing anything, please contact us — most problems can be fixed with an email.
Changes to these Terms
When we make a material change, we post the new version here and ask each Organizer's administrators to review and accept it the next time they sign in. The change applies to your account once you accept it; if you do not accept it, you may stop using the service and close your account. Fee increases are different: we will still email Organizers at least 30 days before any fee increase, as Section 5 says. For people who pay, volunteer or donate through an event site, the version posted here at the time of the purchase or sign‑up applies.
